WhatsApp Terms of Service

This document is provided in English.

These terms apply to people who message ZETU's WhatsApp line and to businesses that use the WhatsApp Business Platform through zWaPi and OmniZetu. By using the service you accept these terms.

1. Parties and definitions

  • ZETU: Zetu Güvenlik Sistemleri Bilişim Telekomünikasyon Medya Sanayi ve Ticaret Limited Şirketi, Üçevler Mah. Aslantaş Sk. No: 7 İç Kapı No: 9, Nilüfer / Bursa, Türkiye.
  • User: a person who messages the WhatsApp line of ZETU or of a business using ZETU's infrastructure.
  • Business Customer: a business that connects its own WhatsApp Business account to OmniZetu through zWaPi.
  • Service: the zWaPi application on the Meta WhatsApp Business Platform and the OmniZetu communication platform.

2. The service

The service delivers information, support, order and appointment notifications and, where you have opted in, promotional announcements over WhatsApp, and lets Business Customers manage these conversations from a single dashboard. It depends on Meta's WhatsApp Business Platform.

3. Rules for users

  • Keep the information you share accurate and up to date.
  • Do not send unlawful, abusive or misleading content, or content that infringes the rights of others.
  • Do not overload the service with bulk or automated messages.
  • Do not share other people's personal data without their knowledge and a lawful basis.
  • Comply with the WhatsApp Terms of Service.

4. Message preferences

Service notifications are sent as part of the service you use. Promotional messages are sent only if you opted in and can be stopped at any time by replying “STOP”.

5. Business Customer obligations

  • Comply with the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy.
  • Obtain and record prior opt-in consent from the people you message, and comply with applicable electronic marketing laws (including Turkish Law No. 6563 where it applies).
  • Write message templates that follow Meta's rules and are accurate and not misleading.
  • Meet your own obligations as controller towards your customers, including privacy notices, and sign a data processing agreement with ZETU.
  • Do not use the service for prohibited goods or services, spam or fraud.
  • Keep your dashboard accounts secure and report any unauthorised access to ZETU promptly.

6. Fees

Meta's WhatsApp messaging fees and ZETU's service fee are set in the agreement with each Business Customer. Users do not pay ZETU to send messages; mobile data charges are their own.

7. Suspension and termination

ZETU may suspend the service in whole or in part if these terms or Meta policies are breached, if there is a security risk, or if Meta requires it. A Business Customer may disconnect its account at any time in Meta Business Settings or by written notice to ZETU.

8. Availability and automated replies

The service depends on Meta's infrastructure and internet connectivity; ZETU is not liable for outages, delays or undelivered messages outside its control. Some replies may be generated by AI-assisted systems. For binding matters such as prices, contracts and invoices, only written confirmation from an authorised representative applies.

9. Intellectual property

The zWaPi and OmniZetu software, the ZETU brand and content sent by ZETU belong to ZETU or its licensors and may not be copied or used commercially without permission. WhatsApp and Meta are trademarks of Meta Platforms, Inc.

10. Limitation of liability

ZETU is not liable for damage caused by a User's or Business Customer's breach of these terms or by third-party services. Nothing in these terms limits rights that consumers have under mandatory law.

11. Personal data

Personal data is processed in accordance with our WhatsApp Privacy Policy.

12. Changes

ZETU may update these terms. The current version takes effect when it is published on this page.

13. Governing law and jurisdiction

These terms are governed by Turkish law, and the courts and enforcement offices of Bursa, Türkiye have jurisdiction. Consumers keep any rights granted by the mandatory laws of their country of residence, including the right to bring claims before their local courts.
